Occupational Therapists play a crucial role in medico-legal matters by providing assessments and expert opinions related to an individual’s functional abilities and limitations. Some key aspects of their involvement include:
- Functional Assessments: Occupational Therapists evaluate an individual’s ability to perform daily activities and assess the impact of injuries or disabilities on their functional capacity.
- Expert Testimony: Occupational Therapists may serve as expert witnesses in court cases, offering professional opinions on the rehabilitation needs, equipment and services, past gratuitous care, future care, and home/vehicle modification requirements of the individuals involved.
- Report Preparation: They prepare detailed reports that outline the functional limitations of a person, which can be used in legal proceedings to support claims for compensation or to determine the extent of disability.

An occupational therapy medico-legal assessment typically involves evaluating a person’s functional abilities in their home environment, whilst considering any injuries or disabilities they may have sustained. The person will be asked to perform functional tasks within the home environment to ensure objective assessment.
This assessment aims to determine the impact of these conditions on their daily activities, work capacity, and quality of life. Claimants should expect thorough evaluations of physical, cognitive, and psychosocial factors, along with recommendations for rehabilitation, accommodations, or support services.
For further information, please refer to the ‘Claimant Information’ document.
The duration of each assessment is dependent on a number of factors including but not limited to, the extent and complexity of the injury and disability, the age of the claimant, and the size of their home. An average assessment will take between 2 to 4 hours.
For further information, please refer to the ‘Claimant Information’ document.
